6. Medical Information Disclaimer
The Content on this Website, including but not limited to text, graphics, images, and other material, is for informational and educational purposes only. The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.
Never disregard professional medical advice or delay in seeking it because of something you have read on this Website. If you think you or your child may have a medical emergency, call your doctor or emergency services immediately.
MyopiaProgression.com does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on the Website. Reliance on any information provided by this Website is solely at your own risk.
Risk Assessment Tool
Our myopia risk assessment tool is designed for educational purposes only. Results are based on general risk factors and should not be interpreted as a medical diagnosis. The assessment does not replace a comprehensive eye examination by a qualified eye care professional. We strongly recommend scheduling regular eye exams for your child regardless of assessment results.
7. Provider Directory
The provider directory on this Website is provided as a convenience to help parents find myopia management specialists. Inclusion in the directory does not constitute an endorsement, recommendation, or guarantee of any provider's qualifications, competence, or quality of care.
Verification indicates only that the provider submitted documentation confirming they offer myopia management services. It does not constitute credentialing, endorsement, or quality assessment.
Provider information is self-reported or sourced from public records and may change. We encourage users to confirm details directly with the provider before scheduling.
Provider information, including credentials, treatment offerings, and practice details, is self-reported or sourced from public records. While we make reasonable efforts to verify provider information, we do not guarantee its accuracy, completeness, or currency. You are responsible for independently verifying any provider's credentials and suitability for your needs.
The provider directory data, including all provider profiles, contact information, treatment listings, and associated metadata, is the proprietary and copyrighted property of MyopiaProgression.com. Any unauthorized copying, scraping, downloading, harvesting, or redistribution of provider directory data — whether by automated means (bots, crawlers, scrapers) or manual methods — is strictly prohibited and constitutes a material breach of these Terms. Violators agree to pay liquidated damages of not less than $5,000 per incident of unauthorized data extraction, in addition to all actual damages, attorneys' fees, and costs of enforcement. We actively monitor for and detect unauthorized access using technical measures, including canary records and access pattern analysis.
Providers may request updates, corrections, or removal of their listing by contacting [email protected] or by submitting a Correction Request form. Verified correction requests will be processed within 10 business days.
7A. Database Rights & Compilation Copyright
The MyopiaProgression.com provider database is an original compilation protected by copyright as a collective work under 17 U.S.C. §§ 101 and 103. Substantial investment of time, skill, and resources has been made in its selection, coordination, and arrangement.
Compilation Copyright
The provider directory constitutes an original compilation under United States copyright law (17 U.S.C. §§ 101, 103). The selection, coordination, curation, and arrangement of provider data — including the criteria used to identify, categorize, and present myopia management specialists — reflects substantial creative and editorial judgment that is independently protected by copyright, separate from any copyright in the individual records themselves.
Sui Generis Database Rights
In jurisdictions recognizing sui generis database rights (including the European Union under Directive 96/9/EC), MyopiaProgression.com asserts all applicable database rights in the provider directory. The extraction or re-utilization of a substantial part of the contents of this database — whether in a single act or through a series of acts — is prohibited without prior written authorization.
Substantial Investment
MyopiaProgression.com has made and continues to make substantial investment in obtaining, verifying, presenting, and maintaining the contents of this database. This investment includes, without limitation: sourcing and normalizing provider records from public and proprietary sources; manual verification and enrichment of provider credentials and specializations; ongoing curation, deduplication, and quality assurance; and development of proprietary matching, ranking, and search algorithms.
Prohibited Acts
Without limiting Section 4 (Prohibited Automated Access) and Section 7 (Provider Directory), you may not:
- Extract, copy, or re-utilize any substantial portion of the database, whether for commercial or non-commercial purposes

All other trademarks, service marks, and trade names referenced on this Website are the property of their respective owners. Nothing on this Website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark without the written permission of the trademark owner.

- Attribution requirements
- Data accuracy disclaimers and indemnification obligations

You represent and warrant that you own or control all rights to any content you submit, and that such content does not violate any third party's rights or any applicable law.
10. Limitation of Liability
This Website and all content, tools, features, and services are provided "as-is" and "as-available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYOPIAPROGRESSION.COM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THIS WEBSITE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE EXCEED THE AMOUNT YOU PAID TO US, IF ANY, DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless MyopiaProgression.com and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Website; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit to the Website.
12. External Links & Third-Party Content
This Website may contain links to third-party websites. These links are provided for your convenience and do not signify our endorsement of such websites or their content. We have no control over the content of linked websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.
13. Termination
We reserve the right to terminate or suspend your access to the Website immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Use.
Upon termination, your right to use the Website will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
14. Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO A JURY TRIAL.
Agreement to Arbitrate
Except as provided below, you and MyopiaProgression.com agree that any dispute, claim, or controversy arising out of or relating to these Terms of Use, the Privacy Policy, or your use of the Website — including any question regarding the existence, validity, or termination of these Terms — shall be resolved exclusively by final and binding arbitration, rather than in court. The arbitration shall be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, or, for business disputes, its Commercial Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in English and, unless otherwise required by the applicable AAA rules, shall take place on a documents-only basis or via videoconference.
Class Action Waiver
YOU AND MYOPIAPROGRESSION.COM EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. All claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding.
Exceptions — Injunctive Relief for IP Claims
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to protect intellectual property rights (including copyright, trademark, trade secret, and database rights), prevent irreparable harm, or preserve the status quo pending arbitration. The filing of a court action for such relief shall not constitute a waiver of the right to arbitrate the underlying claim.
Small Claims Court
Either party may bring an individual claim in small claims court if the claim qualifies, in lieu of arbitration.
Governing Law & Venue
These Terms of Use shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. For any matters not subject to arbitration under this section, you consent to the exclusive jurisdiction of the federal and state courts located in North Carolina.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. If the class action waiver is found unenforceable in a particular case, then the entirety of this arbitration provision shall be null and void for that case only, and the parties agree that the dispute shall be resolved in court.
15. Entire Agreement
These Terms of Use, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and MyopiaProgression.com regarding the use of this Website, superseding any prior agreements between you and MyopiaProgression.com.
